CC allowed deputies to adopt final amendments to the Constitution at any "next" session of the parliament

The Constitutional Court (CC) made a desicion that the final amendments to the Constitution might be taken at any regular session of the Verkhovna Rada (VR). It is clear due to the decision made public today by the CC, - reports UNIAN.

In particular, the reasoning of the court decision said: "The Constitutional Court notes that the VR may provide for the possibility of adopting a draft law to amend the Constitution as the law in the regulations of the Verkhovna Rada at later next VR session in compliance with provisions stated by section XIII "Amendments to Constitution", the fundamental law of Ukraine".

The result part of the decision states that in the case of the prior approval of the draft law of amendments to the Constitution by a majority of the constitutional composition of the Verkhovna Rada, which was not considered at the next session of the VR, "at the next regular VR session" must be understood as "the next regular session of the Verkhovna Rada is the next session of the parliament to be held in accordance with the provisions of the XIII section "Amendments to the Constitution" of the Constitution of Ukraine and the regulations of the VR, at which a draft law to amend the Constitution of Ukraine, previously adopted by the majority of the constitutional composition of the Verkhovna Rada, will be considered as accepted as the law, if not less than two-thirds of the constitutional composition of the Verkhovna Rada vote for it. "

Journalists who had a lot of questions about the precise definition, if the VR is to adopt it at any session following that at which amendments to the constitution were pre-approved, tried to find out from a representative of the VR in the Constitutional Court Anatoliy Selivanov, but he noted that he still needed to learn the CC’s decision more and refused to comment.

As previously reported, 51 deputies appealed to the Constitutional Court on the official interpretation of the provisions of Article 155 of the Constitution of Ukraine "at the next regular session of the Verkhovna Rada of Ukraine." People's representatives asked to explain whether that means that "the draft law on amendments to the Constitution can be adopted only on the immediately following (by number) session of the Verkhovna Rada after the session at which such a draft law was previously approved; or the adoption of the draft law of amendments to the Constitution may take place at any next session (that is, one that occurs later in time) after the session, at which such a draft law was pre-approved. "
