EU offers assistance to Rada for development of illicit enrichment legislation – Mingarelli

The European Union has offered the expert assistance to the Committee of the Verkhovna Rada in issues of the provision of the law enforcement activity for the preparation of the draft laws on the illicit enrichment. This was stated by the EU Ambassador to Ukraine Hugues Mingarelli, - Interfax-Ukraine reports.

"We have proposed our experts to the Committee of the Verkhovna Rada to prepare the proper draft law and find the solution", - he said.

The Ambassador also expressed the hope that the cooperation with the EU in the macro-financial aid will not suffer.

As previously reported, on the constitutional representation of 59 deputies of Ukraine, the Constitutional Court of Ukraine ruled unconstitutional Article 368-2 of the Criminal Code of Ukraine on the illicit enrichment upon the pretext that the provisions of the article violate the presumption of innocence.

On February 28, 2019, the Verkhovna Rada registered a draft law of the President of Ukraine on amending the Criminal and Criminal Procedure Codes on liability for illegal enrichment (No.1010). It imposes an obligation on the pre-trial investigation authorities to prove the legitimacy of receiving of assets in the ownership of representative of the authorities and punishment for illegal enrichment when there are no signs of abuse of official position and bribery.
