Parents of ATO soldier who was killed near Debaltseve demand from Russia non-pecuniary damages of €120 thousand through court action

The parents of ATO soldier who died as a result of Russian aggression have laid an action against the Russian Federation demanding compensation for non-pecuniary damage caused by the occupation forces. The case will be considered by the Polonsky District Court of the Khmelnytskyi oblast, - Judicial Power of Ukraine reports.

In support of the claims, the plaintiffs indicated that their son had been involved in the defense of independence, sovereignty and territorial integrity of Ukraine in the Donetsk oblast since July 2014. On February 9, 2015, he tragically died, having left with two wounded soldiers, medical assistant and driver from a checkpoint in Debaltseve, Donetsk oblast.

The plaintiffs ask to recover from the Russian Federation non-pecuniary damage to each of the parents in the amount of €60 000.

The very fact of death of a serviceman in the performance of military service duties near Debaltseve of Donetsk oblast as a result of armed aggression of the Russian Federation against Ukraine was established by a decision of the same court in July 2017.

The parents write that it is well known that in February 2014, the military aggression of the Russian Federation against Ukraine began, as a result of which the territory of the Autonomous Republic of Crimea was annexed, territories of the Donetsk and Luhansk oblasts of Ukraine were partially occupied. As a result of these events, the indefeasible right to life of their son was violated, resulting in serious emotional distress of the plaintiffs: heartache, loss of peace, a feeling of insecurity and frustration, loss of reason for being and faith in the future.

The case is scheduled for consideration on November 6, 2018.
