"Chief justice of the DPR" is not guilty and the existence of a terrorist organization is not proved - the court

Selydove City Court of the Donetsk oblast has returned the so-called "chief justice" of the CDDO Eduard Yakubovskiy not guilty. This follows from the court decision from 12 June.

The panel of judges decided that "PERSON_ 1 (E. Yakubovskiy - OstroV) is returned not guilty on the charge of committing a criminal offense stipulated by Part 1 of Art. 258-3 of the Criminal Code of Ukraine (Creation of a terrorist group or organization – OstroV) and justified in connection with the failure of evidence by the prosecution".

The judges pointed out that prosecutors could not prove any crimes committed on the occupied territory.

"The indictment notes a lot of especially serious crimes committed by the terrorist organization and the accused, including massacres, capture of cities, villages, buildings, terrorist acts, etc. However, no evidence of the above-noted circumstances has been provided to the court…. No victim was questioned, no protocols for inspection of destroyed buildings and corpses were provided, no inspections were carried out, no damage was established. Even the court decisions for the committed crimes were not provided", - the decision says (all the offenses indicated on the indictment were committed on the occupied territory where there are also those who had suffered from them – OstroV)

Furthermore, the court drew attention to the fact that the prosecutors did not provide evidence of the very existence of the "DPR" terrorist organization.

The fact that Eduard Yakubovskiy ignored the court session and did not take part in the process personally was in favor of the "chief justice" of the CDDO. According to the court version, prosecutors did not prove that the accused evaded the investigation.

The court decision says that prosecutors could not hand over the suspicion personally, so the court did not recognize Yakubovskiy as a suspect at all.

As it was reported to Ukrainska Pravda in the press service of the Prosecutor's Office of the Donetsk oblast, the judgement will be appealed.

"The Prosecutor's Office of the Donetsk oblast categorically disagrees with the decision of the court that had acquitted the citizen of the Russian Federation Yakubovskiy who currently works in with the DPR and is accused of committing a criminal offense under Article 258-3 of the Criminal Code (participation in a terrorist organization)", - was stated in the department.
